Surrogacy is one of the most joyful routes to parenthood. But it is also one of the most legally complex and misunderstood areas of family law. Here's what every intended parent needs to know before the journey begins, not after:

⚫ The surrogate is the legal mother at birth. Even where the intended parents provide the egg and sperm, the woman who carries and gives birth to the child is the legal mother from delivery. If she's married or in a civil partnership, her spouse or partner may automatically be treated as the child's other legal parent too. Biology and intention don't transfer parenthood - a court order does.

⚫ A parental order is not a formality. Intended parents must apply to the court to become legal parents, and specific statutory conditions must be met before a parental order can be made. Get this wrong or leave it too late, and you could be raising your child without legal parental status.

⚫ There's a time limit for applying. Applications for a parental order should be made within six months of the birth, or the court may have no power to make the order, regardless of how settled the arrangement is.

⚫ The surrogate's consent can't be given too early. Her agreement to the parental order must come no earlier than a set period after birth - it cannot be locked in during pregnancy, however clear everyone's intentions were beforehand.

⚫ Commercial surrogacy arrangements are unlawful in the UK. It is an offence to negotiate a surrogacy arrangement on a commercial basis in the UK. Only reasonable expenses are permitted - meaning careful, transparent financial planning from day one isn't optional, it's essential.

⚫ International surrogacy adds real complexity. Different countries, different rules on parentage, citizenship and immigration. What's straightforward abroad can become a legal tangle back home if it isn't planned for in advance.

Families built through surrogacy are just as real, just as loved, and just as deserving of legal certainty as any other. The law simply hasn't always made that certainty easy to find - which is why early, specialist advice changes everything.
